Lei 8666\/93 e Lei 10520\/02<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Ol\u00e1, domingo, dia 02\/10\/220, dia de vota\u00e7\u00e3o para o 1\u00ba turno das elei\u00e7\u00f5es de 2022 para presidente, senadores, deputados federais e deputados estaduais\/distrital e o dia em que <span style=\"text-decoration: underline;\">iniciar\u00e1 a contagem regressiva de 180 dias para que a atual lei de licita\u00e7\u00f5es, seja substitu\u00edda definitivamente pela nova lei de licita\u00e7\u00f5es<\/span> (<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\" target=\"_blank\" rel=\"noopener\">Lei 14.133\/2021<\/a>).<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Mas ser\u00e1 que os \u00f3rg\u00e3os p\u00fablicos nas esferas federal, distrital, estadual e municipal j\u00e1 est\u00e3o realmente preparados para a implanta\u00e7\u00e3o definitiva da <a href=\"https:\/\/teste.marcossilvaconsultoria.com\/lei-14-133-2021\/\" target=\"_blank\" rel=\"noopener\">nova lei de licita\u00e7\u00f5es<\/a>?<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Pelo andar da carruagem acredito que n\u00e3o, principalmente na esfera municipal, j\u00e1 que dos 5.568 munic\u00edpios (segundo o IBGE) a grande maioria s\u00e3o de m\u00e9dio e pequeno porte e ainda n\u00e3o utilizam a nova lei de licita\u00e7\u00e3o.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Mesmo considerando apenas as capitais dos estados e Bras\u00edlia, ainda h\u00e1 muito o que fazer, pois raro \u00e9 o munic\u00edpio que j\u00e1 promove licita\u00e7\u00f5es pela nova lei de licita\u00e7\u00f5es, nas modalidades de Concorr\u00eancia e Preg\u00e3o Eletr\u00f4nico.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Como sabemos que a publica\u00e7\u00e3o dos editais deve ser atrav\u00e9s do Portal Nacional de Compras P\u00fablicas &#8211; PNCP, fiz algumas pesquisas na data de hoje (22\/09\/22), com os seguintes resultados:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">1 \u2013 Concorr\u00eancia Presencial: 02 Licita\u00e7\u00f5es a n\u00edvel nacional.<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">2 \u2013 Credenciamento: 04 Licita\u00e7\u00f5es a n\u00edvel nacional<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">3 \u2013 Concorr\u00eancia Eletr\u00f4nica: 11 Licita\u00e7\u00f5es a n\u00edvel nacional<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">4 \u2013 Preg\u00e3o Eletr\u00f4nico: 94 Licita\u00e7\u00f5es a n\u00edvel nacional<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">5 \u2013 Dispensa de Licita\u00e7\u00f5es: 449 Licita\u00e7\u00f5es a n\u00edvel nacional<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Como podemos analisar, a \u201c<strong>Dispensa de Licita\u00e7\u00e3o<\/strong>\u201d \u00e9 a que est\u00e1 sendo mais utilizada com as diretrizes da nova lei de licita\u00e7\u00f5es.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">J\u00e1 no estado em que resido (Amazonas) o panorama \u00e9 bem diferente, praticamente n\u00e3o h\u00e1 licita\u00e7\u00f5es pela nova lei de licita\u00e7\u00f5es, vejamos:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">1 \u2013 Concorr\u00eancia Presencial: 00 Licita\u00e7\u00f5es a n\u00edvel estadual.<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">2 \u2013 Credenciamento: 00 Licita\u00e7\u00f5es a n\u00edvel estadual<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">3 \u2013 Concorr\u00eancia Eletr\u00f4nica: 00 Licita\u00e7\u00f5es a n\u00edvel estadual<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">4 \u2013 Preg\u00e3o Eletr\u00f4nico: 00 Licita\u00e7\u00f5es a n\u00edvel estadual<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">5 \u2013 Dispensa de Licita\u00e7\u00f5es: 08 Licita\u00e7\u00f5es a n\u00edvel estadual<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">A ades\u00e3o continua muito baixa, para se ter uma ideia, s\u00f3 no Portal Compras Governamentais (Comprasnet), uma simples pesquisa de 14 dias, registrei a quantidade de 5.102 licita\u00e7\u00f5es previstas, pela antiga <a href=\"https:\/\/teste.marcossilvaconsultoria.com\/legislacao-aplicada-em-licitacoes-publicas\/\" target=\"_blank\" rel=\"noopener\">Lei 8.666\/93<\/a> e Lei 10.520\/02.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">N\u00e3o tenho como calcular, mas acredito que a n\u00edvel nacional, exista agora mais de 10.000 licita\u00e7\u00f5es aguardando a sua abertura, abrangendo a uni\u00e3o, os estados, o distrito federal e os munic\u00edpios, nas modalidades previstas na lei 8666\/93 e <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/2002\/L10520.htm\" target=\"_blank\" rel=\"noopener\">lei 10.520\/02<\/a>.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">06 meses, esse \u00e9 o tempo que falta para que a Lei 8666\/93, Lei 10.520\/02 e parcialmente a Lei 12.462\/11 sejam definitivamente revogadas.<\/span><\/p>\n<h3><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\"><strong>JURISPRUD\u00caNCIA DO TCU: <\/strong> Revoga\u00e7\u00e3o &#8211; Lei 8666\/93 e Lei 10520\/02.<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Quando o assunto \u00e9 Jurisprud\u00eancia, ainda existem muito poucos Ac\u00f3rd\u00e3os que mencionam a nova lei de licita\u00e7\u00f5es e a maioria, \u00e9 apenas para respaldar alguns pontos da atual lei de licita\u00e7\u00f5es.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Fazendo uma pesquisa no Site do Tribunal de Contas da Uni\u00e3o \u2013 TCU, nesta data (22\/09\/2022) encontrei 169 Ac\u00f3rd\u00e3os.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Desses Ac\u00f3rd\u00e3os, a maioria, mencionam as leis, Lei 8.666\/93 e a Lei 13.303\/16, ou seja, n\u00e3o s\u00e3o jurisprud\u00eancias que abordam apenas a nova lei de licita\u00e7\u00f5es.<\/span><\/p>\n<h3><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\"><strong>CONCLUS\u00c3O: <\/strong> Revoga\u00e7\u00e3o: Lei 8666\/93 e Lei 10520\/02<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Ainda falta muito, para que a nova lei de licita\u00e7\u00f5es seja implantada em todo territ\u00f3rio nacional, e a pergunta que fica \u00e9:<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Ser\u00e1 que a revoga\u00e7\u00e3o da Lei 8666\/90 e Lei 10520\/02, ser\u00e3o postergadas?<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Faltando pouco mais de 180 dias, acredito que existem fortes ind\u00edcios que h\u00e1 uma probabilidade muito alta, desta lei ser alterada, dando um prazo maior para sua implanta\u00e7\u00e3o definitiva, n\u00e3o sei mensurar o quanto, mas que existe, existe!<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">E voc\u00ea caro leitor, o que voc\u00ea acha a atual Lei de Licita\u00e7\u00f5es e a lei 10520\/22 ter\u00e3o suas revoga\u00e7\u00f5es adiadas?<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Aguardo seu coment\u00e1rio!<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Lei 8.666\/93 e da Lei 10.520\/02, ter\u00e1 sua Revoga\u00e7\u00e3o Adiada?
