style=\"text-align: center;\"><\/h2>\n<h2 style=\"text-align: center;\"><\/h2>\n<p><strong><span style=\"font-size: 14pt;\">Introdu\u00e7\u00e3o: Infra\u00e7\u00f5es e San\u00e7\u00f5es Administrativas<\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt;\">As Infra\u00e7\u00f5es e San\u00e7\u00f5es Administrativas, na <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2021\/lei\/L14133.htm\" target=\"_blank\" rel=\"noopener\">lei 14.133\/2021<\/a>, denominada Nova lei de Licita\u00e7\u00f5es e Contratos Administrativos \u00e9 abordada no T\u00edtulo IV (Das Irregularidades), Cap\u00edtulo I (Das Infra\u00e7\u00f5es e San\u00e7\u00f5es Administrativas), abrangendo o Art. 155 ao Art. 163.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 14pt;\">Este Cap\u00edtulo (I), trata das <a title=\"Restri\u00e7\u00f5es no Termo de Refer\u00eancia \u2013 Lei 14.133\/2021\" href=\"https:\/\/teste.marcossilvaconsultoria.com\/restricoes-no-termo-de-referencia-2\/\" target=\"_blank\" rel=\"noopener\">irregularidades, infra\u00e7\u00f5es e san\u00e7\u00f5es administrativas<\/a> que podem ocorrer no processo licitat\u00f3rio ou na execu\u00e7\u00e3o do contrato. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Ele enumera as infra\u00e7\u00f5es que podem ser cometidas pelos licitantes ou contratados, as san\u00e7\u00f5es que podem ser aplicadas pela Administra\u00e7\u00e3o P\u00fablica, os crit\u00e9rios para a aplica\u00e7\u00e3o das san\u00e7\u00f5es e as situa\u00e7\u00f5es que impedem a participa\u00e7\u00e3o na licita\u00e7\u00e3o ou na contrata\u00e7\u00e3o. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Ele tamb\u00e9m prev\u00ea a defesa dos agentes p\u00fablicos que agirem de acordo com parecer jur\u00eddico e a responsabilidade da alta administra\u00e7\u00e3o pela governan\u00e7a das contrata\u00e7\u00f5es.<\/span><\/p>\n<p><a href=\"https:\/\/amzn.to\/31r56vn\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-671 size-medium\" src=\"https:\/\/teste.marcossilvaconsultoria.com\/wp-content\/uploads\/2023\/10\/E-Book_02-480x270.png\" alt=\"Infra\u00e7\u00f5es e San\u00e7\u00f5es Administrativas\" width=\"480\" height=\"270\" \/><\/a><\/p>\n<p><span style=\"font-size: 14pt;\">As multas e os <a title=\"Sou funcion\u00e1rio p\u00fablico, posso participar de licita\u00e7\u00f5es?\" href=\"https:\/\/teste.marcossilvaconsultoria.com\/sou-funcionario-publico-posso-participar-de-licitacoes\/\" target=\"_blank\" rel=\"noopener\">impedimentos<\/a> s\u00e3o duas das principais penalidades previstas na nova lei de licita\u00e7\u00f5es e contratos (Lei 14.133\/2021), que entrou em vigor em abril de 2021. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Essas penalidades t\u00eam como objetivo coibir as condutas il\u00edcitas ou inid\u00f4neas dos licitantes e contratados, bem como garantir o cumprimento das obriga\u00e7\u00f5es assumidas nos contratos administrativos.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 14pt;\">As multas s\u00e3o san\u00e7\u00f5es pecuni\u00e1rias que podem ser aplicadas tanto na fase de licita\u00e7\u00e3o quanto na fase de execu\u00e7\u00e3o contratual, conforme os crit\u00e9rios estabelecidos no edital e no contrato. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">As multas podem variar de 0,1% a 10% do valor do contrato, dependendo da gravidade da infra\u00e7\u00e3o cometida pelo licitante ou contratado. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Al\u00e9m disso, as multas podem ser cumuladas com outras penalidades, como a advert\u00eancia, a suspens\u00e3o tempor\u00e1ria ou a declara\u00e7\u00e3o de inidoneidade.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Os impedimentos s\u00e3o san\u00e7\u00f5es que impedem o licitante ou contratado de participar de licita\u00e7\u00f5es ou contratar com a administra\u00e7\u00e3o p\u00fablica por um prazo determinado, que pode variar de um a cinco anos, dependendo da gravidade da infra\u00e7\u00e3o cometida. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Os impedimentos podem ser aplicados tanto na fase de licita\u00e7\u00e3o quanto na fase de execu\u00e7\u00e3o contratual, conforme os crit\u00e9rios estabelecidos no edital e no contrato. <\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Os impedimentos podem ser cumulados com outras penalidades, como a advert\u00eancia, a multa ou a declara\u00e7\u00e3o de inidoneidade.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">A nova lei de licita\u00e7\u00f5es e contratos trouxe algumas novidades em rela\u00e7\u00e3o \u00e0s regras para aplica\u00e7\u00e3o de multas e impedimentos nas licita\u00e7\u00f5es p\u00fablicas. Entre elas, podemos destacar:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\">A cria\u00e7\u00e3o do Cadastro Nacional de Empresas Inid\u00f4neas e Suspensas (CEIS) e do Cadastro Nacional de Empresas Punidas (CNEP), <strong><u>Inciso V, Art. 174<\/u><\/strong>, que ser\u00e3o mantidos pelo Conselho Nacional de Justi\u00e7a (CNJ) e ter\u00e3o acesso p\u00fablico pela internet. Esses cadastros ter\u00e3o o objetivo de reunir as informa\u00e7\u00f5es sobre as empresas que foram sancionadas com multas, impedimentos ou declara\u00e7\u00f5es de inidoneidade pela administra\u00e7\u00e3o p\u00fablica em todas as esferas.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">A possibilidade de aplica\u00e7\u00e3o de multa morat\u00f3ria <strong><u>(Caput do Art. 162)<\/u><\/strong> ao contratado que atrasar a entrega do objeto contratado, sem preju\u00edzo da multa compensat\u00f3ria por eventuais danos causados \u00e0 administra\u00e7\u00e3o p\u00fablica. A multa morat\u00f3ria ser\u00e1 calculada sobre o valor da parcela em atraso, \u00e0 raz\u00e3o de 0,1% ao dia, at\u00e9 o limite de 10%.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">A possibilidade de aplica\u00e7\u00e3o de multa ao licitante que deixar de apresentar a documenta\u00e7\u00e3o exigida para a habilita\u00e7\u00e3o <span style=\"text-decoration: underline;\"><strong>(Inciso IV do Art. 155)<\/strong><\/span> ou a proposta dentro do prazo estabelecido no edital, sem justificativa aceit\u00e1vel pela administra\u00e7\u00e3o p\u00fablica. A multa ser\u00e1 calculada sobre o valor estimado da contrata\u00e7\u00e3o, \u00e0 raz\u00e3o de 0,5% ao dia, at\u00e9 o limite de 10%.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">A possibilidade de aplica\u00e7\u00e3o de impedimento <strong><u>(inciso III do Art. 156)<\/u><\/strong> ao licitante que praticar atos il\u00edcitos para frustrar os objetivos da licita\u00e7\u00e3o, como fraude, conluio, corrup\u00e7\u00e3o ou interfer\u00eancia indevida no processo licitat\u00f3rio. O impedimento ser\u00e1 aplicado pelo \u00f3rg\u00e3o ou entidade respons\u00e1vel pela licita\u00e7\u00e3o, sem preju\u00edzo das demais san\u00e7\u00f5es cab\u00edveis.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 14pt;\">Vale lembrar, que esta lei modificou o C\u00f3digo Penal (<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Decreto-Lei\/Del2848.htm\">Decreto-Lei n\u00ba 2.848, de 7 de dezembro de 1940<\/a>), acrescentando o <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/Decreto-Lei\/Del2848.htm#capituloiib\">\u201cCAP\u00cdTULO II-B<\/a> \u201cDOS CRIMES EM LICITA\u00c7\u00d5ES E CONTRATOS ADMINISTRATIVOS\u201d no T\u00edtulo XI do referido Decreto.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">O Art. 178 da lei 14.133 trata dos crimes em licita\u00e7\u00f5es e contratos administrativos, que foram inseridos no C\u00f3digo Penal como um novo cap\u00edtulo. Alguns dos coment\u00e1rios sobre esse artigo:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\">O artigo 178 revoga imediatamente os artigos 89 a 108 da lei 8.666, que tratavam dos crimes na antiga lei de licita\u00e7\u00f5es, e entra em vigor na data da publica\u00e7\u00e3o da nova lei, seguindo o princ\u00edpio da retroatividade da lei penal mais ben\u00e9fica<a href=\"https:\/\/www.tce.sp.gov.br\/legislacao-comentada\/lei-14133-1o-abril-2021\/178\">1<\/a>.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">A cria\u00e7\u00e3o de novos crimes, como o de omiss\u00e3o grave de dado ou informa\u00e7\u00e3o por projetista, que visa coibir a pr\u00e1tica de elabora\u00e7\u00e3o de projetos b\u00e1sicos ou executivos incompletos ou defeituosos, que geram preju\u00edzos \u00e0 Administra\u00e7\u00e3o P\u00fablica e aos contratados<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">O artigo 178 substitui a express\u00e3o \u201cdeten\u00e7\u00e3o\u201d por \u201creclus\u00e3o\u201d na maioria dos crimes, o que implica no in\u00edcio da pena em regime fechado, e tamb\u00e9m estende os prazos das penas, tornando-os mais severos<a href=\"https:\/\/www.jusbrasil.com.br\/busca?q=Art.+178+da+Lei+14133%2F21\">3<\/a>.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">O artigo 178 prev\u00ea a responsabiliza\u00e7\u00e3o penal tanto dos agentes p\u00fablicos quanto dos particulares que participam das licita\u00e7\u00f5es e contratos administrativos, buscando coibir as condutas il\u00edcitas que prejudicam a Administra\u00e7\u00e3o P\u00fablica e o interesse p\u00fablico<a href=\"https:\/\/www.jusbrasil.com.br\/busca?q=Art.+178+da+Lei+14133%2F21\">3<\/a>.<\/span><\/li>\n<\/ul>\n<p><strong><span style=\"font-size: 14pt;\">Conclus\u00e3o: Infra\u00e7\u00f5es e San\u00e7\u00f5es Administrativas<\/span><\/strong><\/p>\n<div data-pm-slice=\"1 1 [&quot;table&quot;,{&quot;style&quot;:null,&quot;summary&quot;:null,&quot;width&quot;:&quot;875px&quot;,&quot;cellspacing&quot;:null,&quot;cellpadding&quot;:null,&quot;align&quot;:null,&quot;cols&quot;:[{&quot;width&quot;:875}],&quot;backgroundColor&quot;:null,&quot;color&quot;:null,&quot;selected&quot;:false},&quot;tr&quot;,{&quot;style&quot;:null,&quot;backgroundColor&quot;:null,&quot;textAlign&quot;:null,&quot;verticalAlign&quot;:null,&quot;color&quot;:null},&quot;td&quot;,{&quot;style&quot;:null,&quot;abbr&quot;:null,&quot;nowrap&quot;:null,&quot;height&quot;:null,&quot;colspan&quot;:1,&quot;rowspan&quot;:1,&quot;colwidth&quot;:[875],&quot;backgroundColor&quot;:null,&quot;textAlign&quot;:null,&quot;verticalAlign&quot;:null,&quot;color&quot;:&quot;&quot;,&quot;inversionType&quot;:&quot;smart&quot;}]\" data-en-clipboard=\"true\"><span style=\"font-size: 14pt;\" data-fontfamily=\"handwritten\">O T\u00edtulo IV do projeto da nova lei de licita\u00e7\u00f5es estabelece um regime das irregularidades que amea\u00e7am a legitimidade das licita\u00e7\u00f5es e contratos administrativos.
